1. Acceptance of Terms

By accessing or using the Smart Tradie platform (the “Platform”), owned and operated by SWA (Vic) Pty Ltd (ACN 626 499 956), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use the Platform.

2. Platform Purpose and Use

Smart Tradie is a SaaS platform designed to assist homeowners and tradespeople in managing home improvement projects, leveraging artificial intelligence (AI) to enhance communication, task organization, and decision-making. You agree to use the Platform for lawful purposes only and to provide accurate and up-to-date information.

3. AI Usage and Data Management

Smart Tradie incorporates AI features to help generate project insights, evaluate trade suitability, and streamline user experience. While AI recommendations are provided, you are responsible for all final decisions.

We collect and process data in accordance with our Privacy Policy. Data may be used to improve our AI models, personalize your experience, and enhance platform functionality. We do not sell personal data. Data may be stored or processed overseas using trusted service providers that meet relevant security and privacy standards.

4. Fees and Subscriptions

Smart Tradie offers both free and paid subscription plans. Paid features may include advanced AI insights, project tracking, or premium support. By subscribing, you authorize us to charge your payment method on a recurring basis unless canceled prior to the renewal date.

Fees are displayed at the time of sign-up and may be subject to change with prior notice. You may cancel your subscription at any time, and your access to paid features will remain until the end of the billing cycle. No refunds are offered for partial use unless required by applicable law.

5. Intellectual Property

All intellectual property on the Platform, including software, text, logos, AI-generated outputs, and visual content, is owned or licensed by SWA (Vic) Pty Ltd. You are granted a non-exclusive, non-transferable, revocable license to use the Platform for personal or business purposes in accordance with these Terms.

6. User Conduct

You agree not to:

– Use the Platform in any unlawful or abusive manner

– Upload or distribute objectionable content

– Interfere with the security or integrity of the Platform

– Use automated systems to extract data or reverse engineer the Platform

– Impersonate others or misrepresent your affiliation with any person or entity

7. Limitation of Liability

To the fullest extent permitted by law, Smart Tradie and SWA (Vic) Pty Ltd are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including reliance on AI-generated suggestions or third-party content.

8. Termination and Suspension

We reserve the right to suspend or terminate access to the Platform for violations of these Terms, suspected fraud, or at our sole discretion with or without notice. You may terminate your account at any time through your profile settings or by contacting support.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising out of these Terms will be resolved under the jurisdiction of Australian courts.

10. Amendments

Smart Tradie may revise these Terms from time to time. You will be notified of any significant changes, and continued use of the Platform after changes take effect constitutes acceptance of those changes.
